Rent increase

The legal limit of 20 % over 3 years and the deadlines after the proposal is delivered.

How we calculate

  • If the lease says nothing about increases, the landlord may propose in writing an increase up to the comparable usual rent in the area, but together with increases in the last 3 years by no more than 20 % (Section 2249(1) of the Civil Code).
  • A proposal made before 12 months without an increase is disregarded (Section 2249(1)).
  • If the tenant agrees, the increased rent applies from the 3rd calendar month after the proposal is delivered. If the tenant does not agree in writing within 2 months, the landlord may within a further 3 months ask the court to set the rent (Section 2249(3)).
  • If the lease has its own arrangement, such as an inflation clause, increases follow the contract (Sections 2248 and 2249(1)).
